Your privacy is very important to us. We care about your privacy rights and are committed to protecting them. As a result, we have created this Privacy Policy to explain how we collect, use, communicate, disclose, and make use of personal information.
This notice applies across all aspects of our business, including our website, any systems we own and/or operate, and any other services we may offer. Our commitment is to conduct our business in accordance with these principles in order to ensure that the confidentiality of your personal information is protected and maintained.
When we talk about “personal data”, we are referring to identifiable information such as your name, email address, address, phone number(s), support queries, community comments, and other similar pieces of information that can identify you. If you can’t be identified (for example, if data has been aggregated and anonymised) then this notice does not apply.
At times, the language in this notice is informal and simple, however the intentions are serious.
This notice will be updated every now-and-then. For any significant modifications to this notice, we will be sure to contact you and let you know in writing.

Who We Are
Zesty Design Limited, often referred to as “Zesty Design” or “Zesty”, is a registered company in New Zealand with its physical address located at the B:HIVE Building, Smales Farm, 74 Taharoto Road, Takapuna, Auckland 0622. Our website address is https://www.zestydesign.co.nz/ and includes all subdomains.
When this notice refers to ‘we’, ‘us’, or ‘our’, that refers to Zesty Design Limited.
How We Collect Your Data
When you visit our website, or use our services, we collect personal data. Our data collection can broadly be categorised into the following:
Information you provide to us directly; when you visit or use some parts of our website and/or services we might ask you to provide personal data and information to us. For example, we ask for your personal information when you submit an enquiry form, support ticket, or job application, or when you respond to an email from us, subscribe to our mailing list(s), follow us on social media, take part in events, or sign up to our services. If you don’t want to provide your personal data to us, you don’t have to, however it might mean you’re unable to use some parts of our website or services.
Information we collect automatically; we collect some information about you automatically when you use our website and/or services. These include (but aren’t limited to) your IP address and device type, and generalised location such as your suburb/city/country. We also collect information about how you have used our website/services, such as what pages you’ve visited, links you’ve clicked on, and how you’ve interacted with our website. This information is collected as it is useful for us to understand how you’re using our website/services so we can continue to provide the best, most relevant experience possible. Some of this information is collected using cookies and similar tracking technologies.
Information we get from third parties; the majority of the information we collect about you, is collected directly from you. Sometimes we might collect personal data about you from other sources, such as publicly available materials or trusted third parties like our marketing and research partners. We use this information to supplement the personal data we already hold about you, in order to better inform, personalise, and improve our services, and to validate the personal data you provide.
Where we collect personal data, we will only process it:
- To perform a contract with you, or
- Where we have legitimate interests to process the personal data and they’re not overridden by your rights,
- Or in accordance with a legal obligation, or
- Where we have your consent.
If we don’t collect your personal data, we may be unable to provide all our services to you, and some functions and features on our website may not be available to you.

How We Can Share Your Data

Our Commitment To Your Privacy
- Before (or at the time of) collecting any personal information about you, we will identify the purposes for which information is being collected.
- We will only collect and use personal information to fulfil the purposes we’ve specified (and for other compatible purposes), unless we obtain the consent of the individual concerned, or as required by law.
- We will only retain your personal information for as long as necessary to fulfil those purposes.
- We will only collect personal information by fair and lawful means and, where appropriate, with the knowledge and consent of the individual concerned.
- The personal data we collect should be relevant to the purposes for which it is to be used, and should be accurate, complete, and up-to-date.
- We will protect all personal data and information by reasonable security safeguards against theft or loss, as well as unauthorised access, disclosure, copying, use, or modification.
- We will make our policies and practices relating to the management of personal information readily available to our customers upon request. In line with the changes to the Privacy Act (being brought into force on December 1st 2020), Zesty Design is committed to meeting all requirements, including to report any privacy breaches. If a privacy breach occurs, and it causes or has the potential to cause serious harm, Zesty Design will take reasonable steps to inform any and all affected people, and the Privacy Commissioner.
- In line with the changes brought to the Privacy Act (being brought into force on December 1st 2020), Zesty Design is committed to strengthening cross-border protections. If and when Zesty Design engages with entities overseas (outside of New Zealand’s borders), Zesty will take reasonable steps to ensure that any personal information and data that is sent overseas is protected by comparable privacy standards, and that the entity is willing to comply with New Zealand privacy laws.
Security
When it comes to your personal data and information, security is a priority for us. We are committed to protecting your personal data and have appropriate technical and organisational measures in place to ensure this happens.
Retention
To fulfil the purposes specified, we may retain your personal data. The length of time we keep your personal data depends on what it is, and whether we have an ongoing business requirement to retain it (for example, to provide you with a service you have requested, or to comply with an applicable service related to the use of any of our systems, products, or services).
We’ll retain your personal data for the duration of our relationship, and for a period afterwards where we have an ongoing business requirement to retain it (in accordance with our data retention policies and practices).
Following that period, we’ll ensure it is deleted or anonymised.
Zesty Design’s Use of Remarketing with Google Analytics
In order to capture information about page visits, we collect cookies on our website. This information is anonymous and Zesty Design will only use this information internally to deliver the most effective content to our website visitors. Information from these cookies is used to;
- Gaugepage popularity,
- Analyse traffic patterns on our website,
- Guide the development of improvements to our website.
Zesty Design does not require that you accept these cookies. However, if you decline to accept any cookies, some functionality on our website, our products/services, may be disabled for you. You are able to set your web browser to notify you when you receive a cookie, giving you an opportunity to decide whether or not to accept it.
Zesty Design never gives away information about our users. If you choose to email us and provide personally identifiable information about yourself, Zesty Design will only use this information to respond to, or engage with, your enquiry.
Zesty Design will not sell, rent, or otherwise disclose that information to third parties, unless such disclosure is necessary for the purposes set forth within this Policy, by law, or a policy or notice contained or associated with a specific Zesty Design product or service.
Zesty Design uses analytics data and the DoubleClick cookie to serve adverts based on a user’s prior visits to our website. Website visitors may opt out of the DoubleClick cookie by visiting the Google Advertising Opt-Out Page. They may also opt out of Google Analytics by visiting the Google Analytics Opt-Out Page. Google has additional information available about their Remarketing Privacy Guidelines, Policies, and Restrictions.
An anonymised string created from your email address (also referred to as a “hash”), may be provided to the Gravatar service to see if you’re using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture may become visible to the public in the context of your comment.
Media
If you upload images to our website, you should avoid uploading any images that contain embedded location data (EXIF GPS). Website visitors can download and extract any location data from images on the website.
Contact Forms
If you leave a comment on our site, or submit an entry to any of our forms, you may opt-in to saving your name, email address, and website in cookies. These are for your convenience so that you don’t have to fill in your information again when you leave another comment. These cookies will last for up to one year.
If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie does not contain any personal data and is removed when you close your browser.
When you login to our website, we will also set up several cookies to save your login information and your screen display preferences. Login cookies last for up to two days. Screen display preference cookies last for up to a year. If you select “remember me” when logging in, your login cookies will persist for two weeks. If you log out from your account, your login cookies will be discarded.
If you publish or edit an article, an additional cookie will be saved in your browser. This cookie does not contain any personal data and simply indicates the Post ID of the article you just edited. It will remain for up to one day.
Embedded Content From Other Websites
Some pages, posts, and articles on this website may include content that has been embedded from other websites or services (such as videos, images, articles, and more). Content that has been embedded from other websites/services behaves in the exact same way as if the visitor has visited that website, or the website of that service.
These websites may collect personal data about you, use cookies, use additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account with, or are logged into, that website.
Your Rights
The personal data we collect about you is yours, and you have certain rights relating to it. When it comes to our marketing communications, you can request that we don’t send these to you at any time. To do this, simply follow the unsubscribe instructions within that marketing communication, or send your request to zesty@zestydesign.co.nz.
Your rights also include:
- The right to know what personal data and information we hold about you, and to ensure it is correct and up-to-date.
- The right to request a copy of the personal data and information we hold about you, or ask us to restrict processing it, or delete it.
- The right to object to our continues processing of your personal data.

If you aren’t happy with how we are processing your personal information and data, please let us know by sending an email to zesty@zestydesign.co.nz. We will review and investigate your complaint, and will aim to get back to you within a reasonable timeframe. You can also complain to your local data protection authority, and they will be able to advise you on how to submit a complaint.
